Determine your status
Do you place a general-purpose AI model on the EU market, or put one into service in the EU — directly or through a downstream provider established in the EU?
Was the model trained using self-supervised learning at scale on large amounts of data, such that it displays significant generality and can competently perform a wide range of distinct tasks, and can be integrated into a variety of downstream AI systems?
This maps to the EU AI Act's definition of a "general-purpose AI model".
Is the model released under a free and open-source licence that allows access, use, modification and redistribution, with its parameters (including weights), architecture and usage information made publicly available?
Was the model trained using a cumulative amount of compute estimated to exceed 10^25 floating-point operations (FLOPs), or has it otherwise been designated by the European Commission as presenting systemic risk?
10^25 FLOPs is the rebuttable-presumption threshold set out in the EU AI Act (Article 51 and Annex XIII). The European Commission can adjust this threshold by delegated act, so confirm the current figure and your own compute estimate with qualified counsel before relying on this for a compliance decision.
